In the 3-2 decision, the board cited “sound policy reasons” for returning to the standard it has applied throughout most of its history, which permits the board to evaluate the interests of employees both within and outside the petitioned-for unit without regard to whether those groups share an “overwhelming” community of interests. AHA has <a href="http://news.aha.org/article/aha-coalition-file-amici-briefs-in-nlrb-case" target="_blank">objected</a> to the 2011 standard, noting that the traditional standard properly balanced the National Labor Relations Act's community-of-interest standard and the board's policy against the proliferation of bargaining units while imposing the fewest barriers to the integrated delivery of health care.</p> Tue, 19 Dec 2017 09:36:00 -0600 Working with Employees NLRB reinstates prior joint-employer standard /news/headline/2017-12-15-nlrb-reinstates-prior-joint-employer-standard <p>The National Labor Relations Board yesterday <a href="https://www.nlrb.gov/news-outreach/news-story/nlrb-overrules-browning-ferris-industries-and-reinstates-prior-joint" target="_blank">overruled</a> a 2015 board decision adopting a new joint-employer standard and returned to the previous standard that governed joint-employer liability, concluding that the reinstated standard adheres to the common law and is supported by the NLRA’s policy of promoting stability and predictability in bargaining relationships. “In all future and pending NLRB cases, two or more entities will be deemed joint employers under the National Labor Relations Act if there is proof that one entity has exercised control over essential employment terms of another entity’s employees…in a manner that is not limited and routine,” the board said. The bill would roll back a 2015 National Labor Relations Board decision to consider two separate entities joint employers of the same employees if they have any degree of indirect or reserved control over matters governing the essential terms and conditions of employment.
