HHS to continue administering, enforcing all aspects of ACA

The Department of Health and Human Services this week issued a confirming that the agency will continue administering and enforcing all aspects of the Affordable Care Act. 鈥淭he recent U.S. District Court decision regarding the Affordable Care Act is not an injunction that halts the enforcement of the law and not a final judgment,鈥 HHS said. 鈥淭herefore, HHS will continue administering and enforcing all aspects of the ACA as it had before the court issued its decision. This decision does not require that HHS make any changes to any of the ACA programs it administers or its enforcement of any portion of the ACA at this time.鈥 On Dec. 14, a federal judge in Texas the entire ACA unconstitutional because Congress repealed the tax penalty enforcing the law鈥檚 individual mandate. Seventeen Democratic attorneys general have asked the judge to confirm that the ACA remains in effect nationwide and allow for a prompt appeal of his decision.
