The U.S. Court of Appeals for the Federal Circuit yesterday by several insurers for the full court to rehear a case involving the Affordable Care Act’s temporary risk corridors program. In June, a three-judge panel of the court reversed a lower court ruling that the federal government failed to satisfy its payment obligations to insurer Moda Health Plan under the program. Moda, Land of Lincoln Mutual Health Insurance Co., Maine Community Health Options and Blue Cross and Blue Shield of North Carolina each filed petitions for a rehearing. Circuit Judges Pauline Newman and Evan Wallach dissented in the 9-2 decision not to rehear the case.
