More than 40 organizations, including the AHA, today urged House and Senate leaders to swiftly pass the Creating and Restoring Equal Access to Equivalent Samples Act (S. 974/H.R. 2212). The legislation would allow generic drug manufacturers facing certain anticompetitive delay tactics to bring an action in federal court for injunctive relief. 鈥淭he CREATES Act is a narrowly targeted, bipartisan, pro-competition and market-based solution to these abuses that cost patients, job-creators and taxpayers billions of dollars each year,鈥 the letter states. 鈥溾e thank the bipartisan, bicameral sponsors of this important legislation for the work that they have done to, in the words of FDA Commissioner Scott Gottlieb, 鈥榚nd the shenanigans鈥 by certain brand name companies, and we strongly encourage Congress to pass the CREATES Act without delay.鈥
